Environmental Insurance 101: Using Environmental Insurance as a Risk Mitigation Tool
Do you have a basic understanding of the role environmental insurance can play in managing environmental risk? Do you sputter helplessly when a client asks you if environmental insurance could help deal with an environmental problem? Do you know the difference between Pollution Legal Liability policies, cost cap, excess of indemnity or lender’s environmental policies? What the heck is “zombie” insurance anyway? How much does environmental insurance cost, and how does an insurer decide to issue a policy (and then pay a claim?) What are the different roles of an insurance broker, underwriter, and claims adjuster? As an environmental professional (whether you are a consultant, attorney, engineer, etc.), it’s important to have some knowledge of the available insurance options to be able to spot instances where insurance can add value and mitigate environmental risk for a property or a project. Max West Aon
Max West has 20 years of experience as an underwriter and insurance broker for environmental and professional liability insurance. Max specializes in customizing, negotiating and placing environmental insurance for all types of transactions, including but not limited to coverage for, developers, lenders, real estate and mergers & acquisitions. In addition to his deep technical expertise in matching environmental exposures with appropriate Insurance programs, Max has wide-ranging experience in the broader business issues surrounding such applications of insurance. He has been involved in dozens of transactions involving transfers of businesses or real estate, ranging from brownfield deals to portfolios of over a thousand properties. Through this experience he has developed a critical appreciation for the key commercial drivers behind such transactions and the flexibility, creativity and speed needed to close deals.
Max holds a BS Honors Degree in Environmental Management from Southampton – England.
Brett L. Warning Emerson & Elder, PC Brett L. Warning provides counsel to clients in a range of insurance, commercial and environmental matters, including environmental coverage issues. With over three decades of experience, Brett brings a broad-range perspective to resolving clients’ matters. Brett has successfully litigated cases in state and federal courts in sixteen states across the country. Brett is also a Cook County Arbitrator with Chair designation. Brett is a former Assistant Regional Counsel with the U.S. Environmental Protection Agency, Region V, and was selected to be an Acting Section Chief, supervising a group of attorneys. Brett has extensive experience with CERCLA, RCRA and UST matters both on behalf of U.S. EPA and on behalf of private clients.
Jamie Langes PHLY E&S Insurance Solutions Jamie Langes is an Assistant Vice President and Regional Underwriting Manager for PHLY E&S Insurance Solutions’ Environmental products in the Midwest Territory. Her current responsibilities include underwriting and providing solutions to client’s environmental insurance needs; interaction and education of brokers regarding environmental risks and exposures; managing a team of talented and experienced underwriters to deliver creative, tailored environmental product solutions in the marketplace. Prior to her employment with PHLY E&S Insurance Solutions, Jamie was an Environmental Senior Underwriter for American International Group (AIG) in the Midwest providing insurance solutions, generating production in new and renewal business, and developing relationships with her assigned brokers. Prior to her employment with AIG, Jamie was an Environmental Client Advisor at Marsh USA, Inc. in their Environmental Practice where her main duties included coverage negotiation, proposal preparation, and client advisory services. Previous employment also includes Environmental Risk Analyst for First Industrial Realty Trust, Inc. (FIRT) performing due diligence analytics for industrial and commercial property acquisition and disposition transactions.
Larry Griffin Beazley Larry Griffin is a claims team leader at Beazley, a Lloyd’s of London based specialty insurer. In his current role, Larry oversees Beazley’s environmental liability claims team, as well as Beazley’s architects and engineers and lawyers professional liability lines. Beazley’s environmental products include site pollution legal liability, contractors’ pollution liability, lenders pollution legal liability and other specialty pollution products, such as cost-cap. Previously, Larry worked for five years as focus group leader for environmental claims. In this role, Larry drew upon his experience representing clients in complex toxic tort and environmental matters at a leading international law firm based in Chicago to work closely with Beazley’s insureds to develop and implement innovative strategies to resolve their pollution liabilities. Larry also has significant experience evaluating and resolving complex professional liability claims for environmental consultants, lawyers and accountants. Prior to joining Beazley, Larry graduated from Fordham University Law School and Boston College.
